Peru establishes new fines for outsourcing

Peru’s current administration is implementing new fines and penalties for companies who are outsourcing some of their operations to third-party service providers.
Through Supreme Decree No. 015-2022-TR, the Ministry of Labor and Employment Promotion (MTPE) determined that companies who will outsource their core businesses will be sanctioned with an S/ 241,638 ((US$63,033) fine.
The exact amount will be applied to companies that will extend the use of labor outsourcing outside of the main activities and those who will utilize outsourcing as a simple provision of personnel.
Employers will also be sanctioned S/ 241,638 ((US$63,033) if they terminate contract workers who have been displaced for the development of activities that are part of the core of the business.
Lastly, companies who will breach the employment contracts of their outsourced employees and not inform said workers of any change in their organization would be sanctioned with a fine for a serious infraction of up to S / 120,152 (US$31,342).
