Elon Musk flags ‘misuse’ of H-1B visas, U.S. jobs impact

MUMBAI, INDIA — Elon Musk has brought attention to the H-1B visa program, suggesting that some outsourcing firms may be taking advantage of the system, raising questions about the impact on United States employment, according to a report from The Times of India.
Speaking on Nikhil Kamath’s WTF Podcast Episode 16, Musk said that certain companies have kind of gamed the system on the H-1B front, highlighting growing scrutiny of foreign labor and its role in the American workforce.
H-1B visa usage under the spotlight
Musk elaborated on what he sees as misuse of the visa program, particularly by outsourcing firms. “I think there’s been some misuse of the H-1B program,” he stated, adding that these companies are particularly responsible for manipulating visa allocations to bring in foreign workers.
These comments follow policy changes in the U.S., where President Trump signed a proclamation introducing a new $100,000 annual fee for H-1B visa applicants.
White House Press Secretary Karoline Leavitt explained that the move aims to protect American jobs while encouraging foreign investment.
“The President does not support American workers being replaced… He wants to see the American manufacturing industry revitalized better than ever before,” Leavitt said, as quoted by White House officials.
Global implications and industry dialogue
The debate around H-1B visas has implications beyond the U.S., particularly for countries like India. Former Reserve Bank of India Governor Raghuram Rajan highlighted potential risks posed by the proposed U.S. Halting International Relocation of Employment (HIRE) Act.
“One of our biggest concerns is not so much the goods tariffs but whether they try and find ways of imposing tariffs on services. This is a threat,” Rajan said in conversation with DeKoder.
“The US Congress is debating the HIRE Act, which aims to tax outsourced work. How that’ll be implemented is anybody’s question, but this creeping of tariffs beyond goods to services to Indian visitors into the US through the H-1B route – these are all concerns,” he said.
