H-1B denials target IT outsourcing wage levels
KERALA, INDIA — The United States Citizenship and Immigration Services (USCIS) denied and revoked multiple H-1B petitions at a major IT consulting company on September 5, citing wage level classifications below what the positions’ duties required, as Indian nationals accounted for 71% of all approved H-1B beneficiaries in fiscal year 2024.

Jennifer Hunt, economics professor at Rutgers University and former chief economist at the United States Labor Department, said the practice created “unfair competition for US workers,” as a Mathrubhumi report found USCIS confirmed it denied petitions for “skilled technology positions that were classified at wage levels below those supported by the jobs’ duties and requirements.”
The enforcement action named no company but targeted roles where wage level designations understated actual job requirements, a gap that allowed some IT consulting firms to place H-1B workers at lower pay tiers than their duties warranted.
When H-1B petitions classify skilled technology positions below their actual wage requirements, USCIS has demonstrated it will revoke approvals rather than allow the wage-level mismatch to stand.
Wharton research: H-1B workers complement U.S. labor
Britta Glennon, assistant professor of management at the University of Pennsylvania’s Wharton School, said “foreign workers can complement rather than simply replace US workers,” as a 2025 Federal Reserve Bank of Richmond study found employers obtaining H-1B visas paid 4% to 5% higher wages to young, college-educated United States workers at those same firms.
The Trump administration’s proposed H-1B filing fee of $103,265 would add cost pressure to IT consulting firms most exposed to the USCIS enforcement action.
Indian nationals accounted for 283,397 approved H-1B beneficiaries in fiscal year 2024, or 71% of all approvals, making enforcement actions at IT outsourcers a structurally significant supply risk for the sector.
