India enacts labor codes to empower women workers

India enacts labor codes to empower women workers

NEW DELHI, INDIA — The Government of India has implemented four sweeping labor codes, a consolidation of 29 laws designed to modernize the country’s workplace regulations. 

According to a report by NDTV, the reforms explicitly prohibit gender discrimination, mandate equal pay, and aim to significantly increase women’s workforce participation through provisions for night shifts, work-from-home flexibility, and access to all industrial sectors.

“The 2025 [labor] reforms are a watershed moment focused on achieving parity for women at workplace and overhauls India’s [labor] economy for a futuristic workforce,” said the Ministry of Finance.

Strategic push for gender equality and inclusion

Clear stipulations are made against gender discrimination in pay, and women are given clearance to work in any sector, including areas formerly barred, such as underground mining and heavy machinery operations, provided they are safe and with their consent. 

Other practices, including the obligatory work-from-home flexibility and mandatory representation on the grievance redressal committees, are aimed at establishing a more accommodating and flexible workplace.

The government is making these changes a case study in an attempt to create workplace parity and directly links the empowerment of women to the country’s economic growth.

The reforms will ease equal access to higher-paid work or to safer, more versatile working conditions, unleashing what the Ministry of Finance calls Nari Shakti to develop a futuristic workforce.

This strategic orientation means that India intends to tap its entire talent pool to increase its contribution to the global value chain.

Modernizing India’s labor laws for gig economy

The four codes, in addition to the gender-specific steps, signify a fundamental restructuring of the archaic Indian system of labor law into a more modernized and consolidated system based on the old colonial systems. 

The government observes that most of the 29 rationalized laws were enacted in the 1930s-1950s, resulting in a complex, discontinuous compliance burden that cannot be easily adjusted to the realities and new forms of work, such as gig work.

The four Codes, on Wages (2019), Industrial Relations (2020), Social Security (2020), and Occupational Safety (2020), are set to be consolidated and are meant to serve as a simplifying tool for compliance, provide universal social security, guarantee fair pay, and codify the protection of new categories of workers. 

According to Union Labor Minister Mansukh Mandaviya’s article, the codes will be pro-worker and pro-growth, providing a platform for a safer working environment and a stronger, more competitive economy. 

Prime Minister Narendra Modi stressed in a post on X, “The world acknowledges India’s rise as a trusted global partner. The new [labor] reforms by the government reflect the commitment to a future-ready economy, simplifying compliance, empowering women workers, and strengthening Bharat’s position in the global value chain!”

These changes, which will modernize laws in India, require gender equality and expand coverage for gig and platform workers, represent a strategic bet: that formalizing and empowering the Indian workforce, women in particular, is key to ensuring its competitive advantage in the future of work.
